אנו פותחים במבצע כתיבת מכתבים לבכירי משרד המשפטים בעניין *1000 **תיקים
פליליים זוטרים שנפתחו נגד כתומים בגין התנגדות לגירוש. *
ב- 1000 התיקים הללו מושקעים משאבי-אנוש ומשאבים כספיים רבים, למרות שאפילו אדם
אחד לא נפגע באותם 1000 מקרים - השוו למשל לקציר הדמים השנתי של תאונות הדרכים,
אותו השלטונות לא מצליחים למגר בין השאר מפני שהם פשוט לא מתאמצים במיוחד.
*הנה הסבר קצר, שגם יכול לשמש לך מכתב לדוגמה *
*(אפשר לשפץ איך שתרצו ואפשר גם למחוק הכל ולנסח משהו אישי):*
*הנידון: חוצפתה של מדינת ישראל המתעקשת להעמיד לדין 1000 כתומים *
1. לפי נתוני עמותת "חוננו", כ-1000 תיקים פליליים זוטרים נפתחו נכון להיום -
כנגד כתומים בגין התנגדות לגירוש. בו בזמן מסתבר לי, שהאייקון של הימין מלפני
עשור, מרגלית הר-שפי, הושלכה לכלא בשעתה על לא-עוול בכפה - כאשר בכירי הממסד
השמאלני (כגון ראש השב"כ דאז עמי איילון, כיום מועמד לראשות מפלגת שלטון)
ידעו זאת כבר אז ושתקו:

2. יש תקדימים לסגירת תיקים סיטונאית, אדרבא בקנה מידה גדול הרבה יותר, למשל
- 13,000 תיקים (!!!) נסגרו באופן סיטונאי בפרקליטות מחוז תל-אביב רק לפני 4
שנים (הנה הפרוטוכל:

3. כיום כבר ידוע, שבניגוד לגירוש ימית -- גירוש גוש קטיף היה מנוגד ל*חוק
יסוד: כבוד האדם וחירותו* שנחקק רק אחרי גירוש ימית. שופטי הבג"צ, שהמוניטין
שלהם יורד ויורד ולא בכדי, הצליחו בקושי להכשיר את גירוש גוש קטיף למרות החוק
*אך ורק בעזרת הטענה* שיש לגירוש "תכלית ראויה" ולכן הוא מותר לפי סעיף מיוחד,
סעיף 8, של "חוק יסוד: כבוד האדם וחירותו ". הממשלה ונשיא הבג"צ דאז, היתממו
לומר שהתכלית הראויה היא... ש"תכנית ההתנתקות תוביל למציאות בטחונית טובה
יותר" (בג"צ ההתנתקות, עמוד 66). איזו בדיחה גרועה! מאז הסתבר שהכל שקר ולא
היתה שום "תכלית ראויה": הגירוש הביא דווקא למציאות בטחונית גרועה יותר, של
רוח גבית לטרור, התחמשות מסיבית בחזית הדרומית, וגשם של קסאמים בכל איזור
הדרום. במילים אחרות: לפי ההגיון, ולא תמיד מערכת משפטית נסמכת על הגיון,
ההתנגדות לגירוש שבגללה הוגשו 1000 התיקים הנ"ל -- היתה חוקית, כאקט של הגנה
עצמית מפני עוול. זאת, היות שהגירוש עצמו, כך הוכח בדיעבד, היה מנוגד לחוק יסוד
כפי שמוסבר לעיל, ולכן היה בלתי חוקי בעליל, מכאן שמותר ואף צריך היה להתגונן
מפניו.
4. לאור כל האמור לעיל, אבקש ש-1000 התיקים נגד הכתומים ייסגרו לאלתר. מתוך
היכרותי את הסביבה החברתית שלי -- לא לכולם יתחשק עוד זמן רב לסכן את החיים,
ולשלם מיסים, למדינה אשר מתנהגת ברשעות שכזו, בחוסר צדק שכזה, ובעיקר - בטיפשות
שכזו, כלפי אזרחיה הנאמנים ביותר.
5. מתפקידך לעצור את ההידרדרות במשבר האימון בין המדינה לבין אזרחיה, לפני
שיהיה מאוחר מדי. אבקש את תשובתך תוך שבועיים כנקוב בתקשי"ר (מסמך המחייב את כל
עובדי המדינה).

*This Is Justice?? (Friends: This is for you to read -- and for you to use
as a letter to the officials listed below)*
**
Dear Sir,
Data from the Honenu legal aid society indicates that approximately 1000
minor criminal charges have been filed so far against Orange protestors
against disengagement. These are purely harrassment; there was nothing
genuinely criminal about the protest actions of these 1000 protestors and
not a single person was hurt by them, even if these protests did embarrass
the government.
Most annoyingly of all, the public interest is NOT to prosecute these
people, not only because they are political protestors in a democracy,
and minor offenders if at all, but because in retrospect it has turned out
that their protests were not illegal -- the disengagement was.
Why? Because forceful eviction of an entire population is against the law -
the so-called Basic Law: Human Dignity and Freedom (Kvod haAdam veHeruto).
The Bagatz High Court only managed to overcome this legal hurdle by finding
that disengagement would increase security -- hence, disengagement was a
"worthy cause" -- hence a legal exception to the general law according to
Section 8 of the law.
Now, as we listen to the news from Sderot nightly, as we hear of the
horrific buildup of arms in the South, as we recall the Hamas victory that
resulted from disengagement, and as we emerge from the Second Lebanon War
whose motivation came directly from disengagement as Chief of Staff Yaelon
specifically pointed out at the time -- we know three things:
(a) Disengagement was definitely NOT a "worthy cause" that increased
security, as claimed by the government in bad faith, and therefore
(b) The forceable deportation component of the Disengement plan was -- to
put it simply -- illegal, due to the Basic Law on Human Dignity and Freedom,
and therefore
(c) Physical resistance to forceable deportation (without causing genuine
harm to even a single policeman or soldier) simply cannot be considered
illegal and certainly is not worthy of the expensive attentions of our
overburdened legal system.
We/I therefore protest the 1000 protests which are resulting in 1000
drawn-out, expensive court cases with no substance, against persons with no
criminal record and no criminal inclinations, who have hurt no-one. I/We
suggest that these cases be closed immediately. Kindly respond to this
letter within 2 weeks as civil servants are required to do *by law *-- Thank
you.

2. If your emails bounce, that is not your fault. Forward them straight to
the State Controller, ombudsman at mevaker.gov.il and add: "I would like to
complain about the Justice Ministry's email system which does not seem to be
working. I request that the Ombudsman please find some working email address
to send my letter to and that he urge the relevant officials to respond as
they are legally obliged to do." (This is what the Ombudsman is there for --
to handle officials who are not bothering to maintain any electronic
connection with the public.)
3. Also, fax to the following 4 offices in the Ministry of Justice:

By the way, "special tasks" means "making life difficult for settlers". That
is essentially all that these special departments have been doing, all day
long, for at least 15 years (since Oslo). They are also, however, in charge
of NOT taking action against Arab opponents of the State. For example, these
self-same departments have been busy for years figuring out how NOT to take
action against MK Azmi Bashara.
4. Send copies of your letters to shil77 at 013.net. That is the email address
of a volunteer parent of one of the 1000 indicted Orange protestors. This
parent will inform all the other 999 families about your letter. It is
important to encourage these 1000 families who sometimes become discouraged
because they don't realize how much all of us care about them and worry
about them.
