*עדכון מהכנסת בנושא צווי ההגלייה שהוצאו נגד 18 מתנחלים*



1. על אף כל ההמולה בכנסת (בעקבות עבודתם הנהדרת של המתנדבים ממבצע "אמץ
ח"כ") -- השלטונות לא החזירו לבתיהם את 18 המתנחלים. אדרבא נוספו עוד 3 צווים,
האחרון כנגד אח שכול - עקיבא לייבוביץ.



מצד אחד המתנחלים משלמים מיסים וחייבים בשירות צבאי כמו כל אזרח ישראל.

מצד שני אותם מתנחלים מקבלים צווי הגבלה כאילו היו מחבלים



2.  חשיבות הנושא - כפולה:

     א. חשיבות הומניטרית: כלפי אותן 21 משפחות

     ב. חשיבות מדינית-קיומית: הפיכת מתנחלים לאזרחים סוג ג' מכשירה
לבבות לוויתורים מדיניים נוספים



3. נימוקי השמאל להצדקת הצווים, כפי שבאו לידי ביטוי בוועדות הכנסת, הם:

 א. *הזקן שהוכה והפועל שכמעט נשרף*: בשמאל מאד טרודים מ-2 מקרים של אלימות
כלפי ערבים, באחד הרביצו לזקן בן 70, בשני ניסו לשרוף מבנה שבתוכו ערבי.
תשובותינו:

* נציגי הפרליטות הודו בעצמם, במסגרת הדיונים בכנסת, שאין להם שום הוכחה למעט
טענת הקרבן, שהמפגעים היו בכלל יהודים.

* מקרי אלימות כגון אלה וחמורים יותר מתרחשים מדי יום ברחבי הארץ.
הפתרון לפשיעה האלימה (ביו"ש כמו בכל מקום אחר): משטרה הגונה מקצועית וחרוצה
שמפטרלת ברחובות - ולא צווים פוליטיים שרירותיים.



ב. *גירוש למעלה אדומים - מותר, גירוש מחבלים - אסור:* המדינה לא מגרשת משפחות
מחבלים מיו"ש לעזה -- ואילו גירוש מתנחלים מותר, מדוע: השמאל טוענת שגירוש הוא
רק כשהאדם נדרש לעבור לאזור מדיני אחר. לכן - אסור לגרש מחבל מיו"ש לעזה -  אבל
מותר לגרש מתנחל, הרחק מביתו וממשפחתו, בתנאי שמגרשים אותו למעלה אדומים או
לבקעת הירדן ולא לעיר בתחום הקו הירוק. תשובתנו: רק איש שמאל יכול לחשוב על
הבחנה כל כך לא רלבנטית לענין. גירוש פירושו -הרחקת האדם  מביתו, משפחתו, ומקור
פרנסתו, לא משנה לאן. (אגב מדוע היה "מותר" לגרש 10,000 תושבי גוש קטיף לתחום
הקו הירוק? כי חוקקו לשם כם חוק מיוחד ואז כל השיקולים מתבטלים והכל הופך
למותר)



ג. *אסור לחשוף, שמקורות המודיעין מדברים שטויות*: בשמאל טוענים שאי אפשר
להעמיד את המתנחלים הרעים לדין מפני שאז ייחשפו המקורות המודיעיניים החיוניים
שמשמשים את  השב"כ נגד המתנחלים. תשובתנו: אנו מנחשים, שלא חשיפת המקור בבית
המשפט היא שמדאיגה אתכם, אלא חשיפת העובדה, שהמקורות המיסתוריים נגד המתנחלים
לא שווים הרבה ומדברים הרבה שטויות. הוכיחו לנו שאנחנו טועים...



מה צריך לעשות כעת? כפי שאתם רואים מטיעוני השמאל לעיל -- מדובר  בבעיה פוליטית
ולא "משפטית". הפתרון, לכן, גם הוא פוליטי. יש צורך לערב ח"כים נוספים, כי מספר
הח"כים שעד כה היו מעורבים (בעיקר ח"כים דתיים וחרדים) לא הספיק כדי להגיע
לתוצאות טובות.

לכן *דחוף!* אנא העבר את המייל הזה (או מייל פרי עטך...) לח"כים הבאים שטרם
התגייסו לנושא, נקווה שבעקבות פנייתך הם יגישו שאילתא או בדרך אחרת יגלו

*Knesset Updt re Banishing Orders*

Here is an update from the Knesset on the topic of the 18 banishment orders
issued against 18 Israeli residents of Judea and Samaria.



a. Despite all the commotion in the Knesset on this topic, due to the
Adopt-an-MK volunteers (thanks guys), the authorities still have not let the
18 men go home; in fact the number of orders which have been issued has
climbed to 21. So, the settler community on the one hand is required to pay
taxes and risk their sons' lives in the army, like any other citizen; on the
other hand they are being openly mistreated as no other Israeli citizen,
Arab or Jew, is mistreated.



b. The issue has implications beyond the humanitarian issues; obviously this
devaluation in the status of the Israelis in Judea and Samaria can have
serious political consequences in strengthening the hostile non-Israeli
population in the same area (the see-saw principle). This is an area just a
bike-ride away from all of Israel's major cities.



c. The left's "logic" in defending these orders became evident in the
various Knesset meetings and consists of the following:

c-1: *Old man beaten, laborer almost burnt*: Two incidents of violence were
reported which are uppermost in the minds of the left. A 70 year old Arab
man reported being beaten and had significant injuries, and a laborer
reported being locked into a building which was set on fire. Both blamed the
Jews

*Our response*: In the Knesset committee discussions  the left did not
produce any proof that these incidents had actually been committed by Jews;
if they were, let the Jews be arraigned; furthermore, regrettably, this type
of violence is far from uncommon in Israel; why the fuss at the highest
governmental levels about Arab victims only?

c-2: *Banishing Jews to Maaleh Adumim is OK; banishing Arabs to Gaza is not
OK*: The left has strongly fixed in its mind a distinction between
banishment which crosses a border or similar political line and banishment
which does not. So, when family members supportive of Arab terrorists were
banished from Judea and Samaria to Gaza, that was not OK. But since Maaleh
Adumim is inside Judea and Samaria, banishing a Jew to there is OK. *Our
response:* Banishing a tax-paying, army serving Israeli citizen from his
home, family and workplace without proven cause is not OK; whether or not a
border-type line is crossed is completely irrelevant to the affected person
and his family. (incidentally, yes, the Gush Katif Jews were banished across
a political line -- that the left justifies by saying that they passed a
special law for that, which in their minds makes the whole thing kosher).

c-3: *Keep the cards close to the chest*: The left claim a major concern
about putting these bad Israelis on trial which, they say, could expose
hence "burn" their informants against the settlers.* **Our response:* For
our part, we are concerned about the opposite problem: that the reluctance
to expose informants has little to do with the purported difficulty with
replacing them and much more to do with the left's awareness that when their
informants' "information" is aired in open court it will be exposed for what
it really is -- nonsense.



What to do now? As you can see from the type of arguments the left are
raising (c-1 to c-3 above), this is a political matter, not a legal matter.
So, the steps to be taken are political as well. Currently, since the MKs
involved were not sufficient, numerically, to get the 21 men home, we need
to ask more MKs to involve themselves ("the law of large numbers"). Kindly
therefore simply forward this entire email (preferably with a few words in
Hebrew from you) to the Knesset Members who are not yet found time to
involve themselves in this issue. Here are their addresses
