האחים דני ואיציק חלמיש מגוש עציון, עלולים להכנס לכלא בעוד שבוע -- אלא אם כן
כולנו נרוץ מייד למכונת הפקס או לטלפון!!



הנה הסיפור:

1. דני ואיציק הורשעו על ירי באויר ובקרקע במסגרת תפקידם כחברי כיתת הכוננות של
היישוב. לדעת בית המשפט, שכמעט תמיד פוסק נגד מתנחלים, גם זה אסור.  הפרטים

2. עורך הדין שלהם ראה בבירור, שהשופטים  ואפילו התובעת, הבינו שלא נעשה צדק.
לכן, הוגשה בקשת חנינה לנשיא המדינה שמעון פרס.



3. מלשכתו של שמעון פרס צלצלו: אכן, בקשת החנינה מונחת לפני הנשיא פרס. אבל,
הזהירו, טיפולו יארך כ-6 חודשים!! לכן שאלו: האם הגשתם בקשה לבית המשפט, לעיכוב
ביצוע גזר הדין (עיכוב כניסתכם לכלא)?



4. הבקשה הנ"ל אכן הוגשה. ואולם, הימים עוברים -- ובית המשפט טרם מצא פנאי לדון
בבקשה. כלומר: יתכן שיתרחש כאן תרגיל: "אין זמן" ביומן בית המשפט, ולכן, דנים
בבקשה רק אחרי שהאחים כבר מאחורי סורג ובריח....בדומה: כבר היו דברים מעולם,
שדיונים אודות שחרור מחבלים התקיימו -- לאחר שהמחבלים כבר שוחררו. מאידך --
כשהיה צורך לקיים משפט זריז לחיים רמון כדי לאפשר לו לחזור לממשלה -- פתאום
מצאו זמן ביומן בית המשפט.



כיצד נוכל לעזור לאחים חלמיש -- לאשתו של דני - לילדיו הפעוטים - ולהורים
המבוגרים של 2 האחים שנשלחים לכלא על לא עוול בכפם?

 נכתוב מייד פקס מנומס למזכיר בית המשפט (הערה: הפקס אינו מופנה לשופט!!). למשל

*2. דיון של הנשיא בבקשה זו אורכת כ-6 חודשים.*

*3. הוגשה בקשה סטנדרטית לעיכוב כניסתם של דני ואיציק לכלא. *

*4. בכל הכבוד, אני ומשפחתי מוחים על כך שמי שמנהל את יומנו של השופט, טרם שיבץ
ביומן  את הבקשה האלמנטרית הזו. *

*5. לא יתכן שנשיא המדינה ניאות לדון בבקשת החנינה של  אנשי הבטחון הנ"ל, ובית
המשפט בפועל מונע מנשיא המדינה את האפשרות לעשות זאת בגלל אי-יכולת לפנות מקום
ביומן.*

*6. אודה על טיפולך הדחוף בבעיה אדמיניסטרטיבית דחופה וכאובה זו.*

* Save Dani and Itzik, the brothers from Gush Etzion!*

Dani and Itzik Halamish, the volunteer security officers  from Gush Etzion
that you may have heard of, may go to jail in a week -- unless we all
IMMEDIATELY send a fax on their behalf. The brothers' story -- by Caroline

President Peres has agreed to consider a special clemency request for these
brothers; it is believed that Peres will agree that justice has not been
done by sending these volunteer security officers to prison for something
they never did. However, Peres's office called the brothers and told them
that the clemency proceeding requires 6 months; the office asked whether
they had filed in court for a 6-month deferral of their sentence. The
brothers filed this request, which is the standard request, in the Jerusalem
District Court. However, inexplicably, this court has yet to decide upon
this request -- no time has been found in the court's schedule to do so!!
This is a familiar trick in other contexts -- petitions to the Bagatz on
release of terrorists have been scheduled for AFTER the terrorists were
released, etc.



Please contact the court's administrative secretary accordingly! Here is a
fax you might wish to send (you can also write one yourself! ) (note: it is
NOT appropriate to write to the judge himself):

*President Peres is looking into clemency for the 2 security officers from
Gush Etzion, Dani and Itizk Halamish, who are said to have shot in the air
and on the ground (not at people). As is standard, these brothers have
petitioned for their jail sentence to be delayed to give the President time
to do so. Unfortunately, the brothers' petition has yet to be placed in the
court's schedule  even though it is clearly very urgent since their jail
sentence starts in a week!*

*I ask that you as a good-faith administrator make sure that the brothers'
urgent petition is given the proper priority in the court docket so the
petition is taken up at a realistic time i.e. before their jail sentence
begins.*
